해상보험의 성격
해상보험은 손해의 보상을 목적으로 하는 보험이다.
해상보험에 있어서 피보험자가 해상 위험에 의하여 손해를 보상받기 위해서는 그에 상응하는 피보험 이익이 존재하여야 한다.
해상보험은 피보험 이익에 발생한 손해의 보상을 경제적 손해로 한정한다.
하더라도 그 원인이 되는 위험이 보험기간이 개시되기 전에 발생한 경우에는 보험자는 그 손해를 보상할 책임이 없.. |
